The Austrian competition authority, BWB, has completed an investigation into potential cartel activities in the road construction sector in Austria between late 2017 and late 2018. The probe revealed anti-competitive behaviors such as customer allocation and exchange of sensitive information related to road construction project tenders between Mageba and Maurer.
Maurer, one of the companies involved, applied for leniency and cooperated extensively with the BWB. As a result, Maurer was not fined but faced a request for a determination of infringement. Maurer acknowledged the wrongdoing and expressed willingness to settle the case amicably.
On the other hand, BWB has proposed imposing a suitable fine on Mageba for its involvement in the alleged cartel activities.
Under Austrian law, a company may be exempted from fines if it is the first to disclose cartel activities and meets certain conditions. The determination of the fine amount by the Cartel Court is based on various factors, with BWB requesting an appropriate penalty in this case, which can reach up to 10% of the company's total group turnover from the previous financial year for violations of competition law.
