20.12.2024 | 🇳🇱 Dutch competition authority
Babboe, a cargo bike manufacturer, has announced a commitment to refund consumers who own cargo bikes with potential safety issues. This decision comes after discussions with the Netherlands Authority for Consumers and Markets (ACM) and is aimed at addressing consumer complaints regarding the initial recall process.
Earlier this year, Babboe initiated a recall for certain cargo bikes due to safety concerns, initially offering affected customers a voucher for a replacement bike. However, many consumers expressed a preference for a cash refund instead. The Dutch Consumers’ Association also voiced dissatisfaction with Babboe's handling of the situation, prompting ACM to intervene.
In response to these concerns, Babboe has expanded its recall policy to include a refund option alongside the replacement bike offer. Consumers eligible for a refund can begin contacting Babboe for this option starting in late January. The refund amount will vary based on the age of the bike. Babboe is also required to provide ACM with regular updates on the status of the recall.
Under consumer protection laws, customers are entitled to safe products. If a product is deemed unsafe, consumers have the right to repairs or replacements. If these options are not feasible or take too long, they can rescind the contract and request a refund, although the amount may be adjusted based on the product's usage.
