The President of the Polish competition authority initiated an explanatory procedure regarding suspicions of anticompetitive practices by digital distribution platform providers in the video game market, aiming to protect game creators, platform suppliers, and gamers.
The investigation includes on-site inspections at the headquarters of Sony group, as well as two video game creators and publishers in Poland, to gather evidence on possible anticompetitive behaviors such as price interference, restrictions on sales, and limiting access to the market for competitors.
If the collected evidence confirms suspicions, the authority may proceed with antitrust proceedings, issuing fines of up to 10% of the company's turnover and up to 2 million PLN for individuals involved in anticompetitive agreements.
Companies and individuals involved in anticompetitive practices have the opportunity to reduce or avoid fines through a leniency program by cooperating with the authority as a 'whistleblower' and providing evidence of illegal agreements.
