The Croatian Constitutional Court rejected a constitutional complaint filed by Presečki grupa, upholding the decision of the Competition Agency regarding prohibited agreements in the bus transport market.


The Croatian Competition Agency (CCA) found that several bus operators, including Presečki grupa, engaged in prohibited agreements that distorted competition in the bus transport market in Međimurje County. The CCA's decision was challenged multiple times, leading to rulings by the High Administrative Court and the Constitutional Court.

After several rounds of appeals and constitutional complaints, the Constitutional Court emphasized the need for a detailed explanation of why certain laws were not applied in the case, particularly the Road Transport Act. The High Administrative Court eventually reversed the CCA's decision based on the Constitutional Court's interpretation.

In a subsequent decision in 2021, the CCA once again found that the bus operators had entered into agreements restricting competition. Fines were imposed on the undertakings for their anti-competitive behavior.

Despite further legal challenges, the High Administrative Court and the Constitutional Court upheld the CCA's decision, emphasizing the validity of the Competition Agency's explanations and its compliance with legal standards.
