Dutch telecom operator VodafoneZiggo acknowledges that it bears responsibility for the telemarketing practices of the company itself as well as for those of companies that make telemarketing calls on its behalf. In a commitment to the Netherlands Authority for Consumers and Markets (ACM), VodafoneZiggo commits to ensuring that the companies that make telemarketing calls on its behalf will comply with telemarketing rules. In practice, this means that those companies, too, will only call individuals who have given prior consent to receiving such calls, and that VodafoneZiggo bears responsibility for those calls. VodafoneZiggo will tighten its supervision of these calls, and will enforce the rules among the companies that make calls on its behalf. VodafoneZiggo took this step after ACM had launched an investigation into the company in connection with the numerous complaints about unsolicited telemarketing calls. ACM will now end this investigation.


Martijn Ridderbos, Member of the Board of ACM, explains: “With this commitment, VodafoneZiggo takes an important step. The company acknowledges that it bears responsibility for all telemarketing activities that are conducted by it and on its behalf. And it commits to checking more strictly whether these telemarketing calls are conducted in accordance with the rules. Going forward, people will only be given commercial offers over the phone if they have consented to receiving such calls. We expect all companies that use telemarketing activities to follow this example. In that way, unsolicited telemarketing calls are stopped, and a level playing field between companies can be created.”
Chain responsibility


It has explicitly been laid down in the commitment decision that not just VodafoneZiggo is bound by these arrangements, but also all companies that make phone calls on its behalf. In addition, they can only make phone calls to individuals that have given prior consent to receiving such calls. If they decide to withdraw that consent, they can no longer be called. VodafoneZiggo bears responsibility for compliance with this commitment among all telemarketing companies it collaborates with. Arrangements about this commitment will be made in advance, and VodafoneZiggo will more strictly monitor companies that act on its behalf, and will ensure that these companies comply with the commitment. VodafoneZiggo recognizes that improvements are necessary. As a gesture of goodwill, VodafoneZiggo has committed to donating 25,000 euros to the National Foundation for Elderly (in Dutch: Nationaal Ouderenfonds) as compensation.
Calling with prior consent


Due to the high number of complaints regarding telemarketing activities by telecom and energy companies, ACM organized a meeting earlier this year to remind them of the rules and of the relevant obligations. For example, companies can only contact individuals if these have explicitly given consent to receiving telemarketing calls. Such consent must have been verified. In this commitment, VodafoneZiggo has explained how it will organize this verification process. ACM has agreed to this because the proposed method acts as a minimum threshold for acceptable conduct in the market. Other companies can build on this.


In addition, the rules governing the contents of telemarketing calls are still in place, which means that the companies that make such calls must be clear about their identity, the reason for the call, and the content of the offer. These rules apply to all companies that use telemarketing for contacting ‘natural persons’: consumers and independent contractors.


ACM’s enforcement of compliance with telemarketing rules stepped upConsumers that are bothered by unsolicited telemarketing calls continue to be able to report these to ACM’s consumer information portal ACM ConsuWijzer. Such reports help ACM find out where irregularities occur and how it can take effective action. Earlier this year, ACM announced it would step up its enforcement of compliance with telemarketing rules. Businesses need to get their processes straight and comply with the statutory requirements. ACM will carry out audits to check whether businesses comply with the rules.

VodafoneZiggo Takes Responsibility for Telemarketing Practices

VodafoneZiggo, a major Dutch telecom operator, has acknowledged its responsibility for telemarketing practices, both for its own actions and those of third-party companies that conduct telemarketing on its behalf. This commitment comes after the Netherlands Authority for Consumers and Markets (ACM) initiated an investigation due to numerous complaints about unsolicited telemarketing calls.

 As part of its commitment to ACM, VodafoneZiggo has pledged to ensure that all telemarketing calls made on its behalf will only target individuals who have given prior consent. This means that the company will tighten its oversight of telemarketing activities and enforce compliance among the companies it collaborates with. The ACM has agreed to end its investigation following this commitment.

 Martijn Ridderbos, a board member of ACM, emphasized the importance of VodafoneZiggo's acknowledgment of responsibility, stating that it sets a precedent for other companies in the industry. He noted that moving forward, individuals will only receive commercial offers via phone if they have explicitly consented to such calls, which is expected to reduce unsolicited telemarketing.

 The commitment also includes provisions that require all telemarketing companies working with VodafoneZiggo to adhere to these rules. If individuals withdraw their consent, they must not be contacted again. VodafoneZiggo will be responsible for ensuring compliance among its partners and will implement stricter monitoring processes.

 In response to the situation, VodafoneZiggo has also agreed to donate €25,000 to the National Foundation for Elderly as a gesture of goodwill. The ACM has been proactive in reminding telecom and energy companies of their obligations regarding telemarketing, emphasizing the need for explicit consent from consumers before making calls.

 ACM plans to enhance its enforcement of telemarketing regulations, allowing consumers to report unsolicited calls through its consumer information portal. This will help the authority identify irregularities and take necessary actions. The ACM will conduct audits to ensure that businesses comply with the established telemarketing rules.

Polish Competition Authority Honors Top Academic Works in Antitrust and Consumer Protection

Today, the Polish competition authority held an awards ceremony for the best master's and doctoral theses in competition protection and consumer rights. This marks the 16th edition of the competition for master's theses and the 14th for consumer protection, alongside the fourth for doctoral dissertations. A record number of submissions were received, with 60 entries leading to the selection of 10 winners, primarily from the University of Warsaw.

 The awarded topics included influencer marketing, energy sector regulations, collusive agreements, and anti-competitive practices within corporate governance. The President of the Polish competition authority, Tomasz Chróstny, expressed his satisfaction with the high level of interest in the competitions and workshops, emphasizing the real-world impact these initiatives have on market protection and consumer welfare.

 The competition was partnered with the Competition Law Association and supported by the Polish Economic Society. The judging panels, composed of distinguished academics and practitioners in competition and consumer law, particularly valued originality, bold theses, logical argumentation, quality of analysis, and methodology in the submissions.

 Among the winners, Zofia Zborowska received the first prize for her thesis on competition restrictions in the context of sustainable development, while Małgorzata Krzemińska won for her work on consumer protection against unfair influencer marketing practices. In the doctoral category, Adrian Bielecki was awarded for his research on combating anti-competitive personal unions in corporate governance.

 Looking ahead, the Polish competition authority is set to launch new editions of the competitions for the best master's and doctoral theses, with a total prize pool of 84,000 PLN, along with opportunities for internships and publication in the UOKiK Library. Additionally, students are invited to apply for the Summer Camp workshops focused on antitrust law.

Like in the year before it, 2024 saw fewer postal items being sent. Numbers went down in both the business mail segment and the consumer mail segment, while the drop was the most marked in the latter segment. The quality also deteriorated further. Letters and postcards arrived on time less often than in previous years. The number of parcels that were sent went up again. This growth led to an increase in the turnover in the parcel market, while the turnover in the postal market decreased further. These are some of the conclusions of the annual Postal and Parcel Markets Scan of the Netherlands Authority for Consumers and Markets (ACM).


ACM has observed that the downward trend in the reliability of the postal market in recent years is also reflected in the substantial increase in the number of complaints that it has received about mail-delivery quality. More and more reports are about postal items that arrive either late or not at all. According to the statutory requirement, at least 95 percent of postal items must be delivered the next day. In 2023, 89 percent of postal items were delivered on time. Last year, that percentage further dropped to 86 percent.
Other trends and developments


Other notable trends and developments include the volume of international parcels increasing much faster (12 percent) than the turnover thereof (5.7 percent). This means that the average revenue per parcel is going down. This trend can be partially explained by the rising popularity of Asian online stores, which often send cheaper parcels.The scan also reveals that the trend of using sustainable transport methods (such as electric buses or cargo bikes) continues. More and more parcels are delivered ‘electrically’. The number of package lockers also increased considerably: from 2,800 to 4,800 (+70 percent). Still, this has not yet led to any major shifts between drop-off options. With over 80 percent, at-home delivery remains the favorite option. Alternatives such as pick-ups at service locations or package lockers are clearly less popular.
ACM’s role in the postal market


ACM is statutorily charged with oversight over the quality of the universal service obligation (USO). This concerns approximately 15 percent of the total national and international mail volumes. The national mail volume consists of approximately 5 percent consumer mail and 95 percent business mail. Business mail (including mail from government organizations) is not statutorily protected. The parcel market is not regulated either, and is therefore not subject to ACM’s oversight.


Each year, ACM publishes the Postal and Parcel Markets Scan, by order of the Ministry of Economic Affairs (EZ). In this Scan, ACM provides an overview of the trends and developments in the sector. The Scan can be accessed through an interactive dashboard.

ACM Reports Decline in Postal Reliability Amid Parcel Growth

The 2024 Postal and Parcel Markets Scan by the Netherlands Authority for Consumers and Markets (ACM) reveals a notable increase in parcel volumes, while the number of postal items sent has decreased. This trend is accompanied by a decline in reliability, with only 86 percent of postal items delivered on time, down from 89 percent in 2023.

ACM's findings indicate that both business and consumer mail segments are experiencing a downturn, with the most significant drop occurring in consumer mail. The authority has also noted a rise in complaints regarding mail delivery quality, reflecting growing consumer dissatisfaction.

In contrast, the parcel market has seen a turnover increase, driven by a 12 percent rise in international parcel volumes, although the average revenue per parcel has decreased. This trend is attributed to the growing popularity of Asian online retailers offering cheaper shipping options.

Additionally, the report highlights a shift towards sustainable delivery methods, with more parcels being delivered using electric vehicles. The number of package lockers has also surged, increasing from 2,800 to 4,800, yet at-home delivery remains the preferred choice for over 80 percent of consumers.

ACM is responsible for overseeing the quality of the universal service obligation (USO), which covers about 15 percent of total mail volumes. However, the parcel market is unregulated and does not fall under ACM's jurisdiction. The annual scan is published at the request of the Ministry of Economic Affairs and provides insights into the evolving postal and parcel landscape.

Gdy nie jest jasne, że oceniać zakupy mogą ci, którzy nic nie kupili, a tym, którzy kupili, nie zawsze przysługuje możliwość wystawienia oceny, to mamy do czynienia z nieuczciwymi praktykami rynkowymi.
                                                                    Jeśli dodamy do tego algorytm, który istotnie zniekształca pierwotny charakter oceny, zwłaszcza negatywnej, to mamy przepis na naruszanie zbiorowych interesów konsumentów.

         Wypowiedź Prezesa UOKiK Tomasza Chróstnego 

„Jak przebiegła transakcja?”, „Daj nam znać o swoich doświadczeniach z tym sprzedającym”. Znasz te komunikaty? OLX.pl to jedna z najpopularniejszych w Polsce platform z ogłoszeniami, dostępna z poziomu strony internetowej oraz aplikacji. Przedmiotem obrotu są rzeczy używane, fabrycznie nowe, a także usługi. Korzystający z serwisu konsumenci mogą zapoznawać się z opiniami na temat innych użytkowników. Z badań przeprowadzonych na zlecenie UOKiK wynika, że opinie są istotnym źródło informacji przed podjęciem decyzji zakupowej dla 86 proc. osób, które kupują w internecie.

Prezes UOKiK sprawdził, kto i kiedy mógł wystawić opinię w serwisie OLX.pl, jaki algorytm stosowała spółka do obliczenia końcowych ocen użytkowników i jak informowała o zasadach obowiązujących na platformie. Za praktyki wprowadzające w błąd nałożył na Grupę OLX karę ponad 28 mln zł.Opinie o transakcjach, których nie było

Uprawnieni do wystawienia opinii w serwisie określani byli jako „kupujący”, co wskazywało, że dokonanie zakupu jest podstawowym kryterium pozwalającym na późniejszą ocenę sprzedającego. Tak jednak nie było, a o problemach związanych z systemem ocen na OLX.pl świadczyły sygnały od użytkowników. „Dostałam negatywną opinię od użytkownika, z którym się nawet nie kontaktowałam. Ani telefonicznie ani na OLX nie mam wiadomości od tego Pana”. „Ci użytkownicy nie kupili niczego ode mnie, co zatem oceniają?”. „W dodatku treść ocen nie jest widoczna, więc potencjalni kupujący mogą myśleć, że kogoś oszukałem, co nigdy nie miało miejsca”. Podobnych skarg było więcej.

– Korzystający z OLX.pl często nie zdawali sobie sprawy z tego, że ocena może być wystawiona przez osobę, która nie dokonała zakupu, a nawet taką, z którą nie mieli żadnego kontaktu. Platforma umożliwiała wystawienie opinii na podstawie „doświadczenia transakcyjnego”. Oceniać mogli też ci, którzy tylko zapytali o produkt, bądź wyświetlili dane kontaktowe przy ofercie. To mogło wprowadzać konsumentów korzystających z portalu w błąd i naruszać ich interesy – mówi Prezes UOKiK Tomasz Chróstny.Na zaproszenie i po kolei

Doświadczenie transakcyjne mogło być złe, dobre lub rewelacyjne, ale żeby je wyrazić, trzeba było poczekać na zaproszenie. Dostęp do zamieszczenia oceny w odniesieniu do wszystkich zakupów nie był taki sam. Serwis OLX wysyłał jedno zaproszenie do wystawienia opinii na tydzień. Zaproszenie do oceny dotyczyło zawsze ostatniego doświadczenia transakcyjnego. Jeśli konsument w danym tygodniu kupował więcej niż raz bądź kontaktował się z kilkoma użytkownikami serwisu, musiał najpierw odpowiedzieć na zaproszenie do oceny ostatniej aktywności. Jeśli tego nie zrobił, nie miał dostępu do wystawienia opinii pozostałym użytkownikom. Dodatkowe utrudnienie mieli korzystający z aplikacji OLX.pl, którzy zaproszenia dostawali w formie powiadomienia push i jeśli je zamknęli bez wystawienia oceny, nie mogli już do nich wrócić. Jak ustalił Prezes UOKiK, konsumenci nie byli właściwie informowani o obowiązujących zasadach oceniania.

– Konsumenci mieli podstawy by sądzić, że kryterium umożliwiającym zamieszczenie opinii była transakcja, nie zaś spełnienie dodatkowych warunków, jak np. otrzymanie zaproszenia od serwisu czy ocena zakupów na platformie w jakiejś kolejności. Takie rozwiązanie wpływało na reprezentatywność, a w konsekwencji na rzetelność ocen prezentowanych na platformie OLX.pl. Konsumenci, którzy w krótkim czasie kupowali częściej, mieli gorszy dostęp do wystawienia oceny sprzedającego, przez co ich głos nie był tak samo odzwierciedlony w ocenach prezentowanych w serwisie – mówi Prezes UOKiK Tomasz Chróstny.Pozytywny liczy się bardziej

Konsumenci skarżyli się na system ocen na OLX z uwagi na możliwość zamieszczania oceny nie tylko przez kupujących, jednak nie mieli szansy odkryć jego innej wady – nieuczciwie działającego algorytmu. Grupa OLX stosowała kilkuetapową metodę obliczania ogólnej oceny użytkownika. Z trójstopniowej skali oceny doświadczenia: rewelacyjne, dobre, złe powstawała skala czterostopniowa: rewelacyjnie, dobrze, nieźle oraz negatywna – nie polecam. Jak ustalił Prezes UOKiK, algorytm stosowany przez spółkę do obliczenia oceny użytkowników zawyżał oceny poprzez dwa mechanizmy. Przypisywał wyższą wagę ocenom pozytywnym niż negatywnym, a dodatkowo oceny mieszczące się poniżej połowy w skali były kwalifikowane i prezentowane jako pozytywne. Konsumenci nie mogli zweryfikować, czy przyporządkowane oceny były adekwatne do opinii zostawianych przez oceniających. Przykładowo użytkownicy OLX.pl nie wiedzieli, że ocena „Nieźle. Większość kupujących jest dosyć zadowolona z tego ogłoszeniodawcy” była przypisywana m.in. sprzedającym, którzy mieli więcej ocen negatywnych niż pozytywnych. W efekcie stosowanych mechanizmów konsumenci zamiast oceny „nie polecam” mogli widzieć ocenę „nieźle (…)”, zamiast oceny „nieźle (…)” ocenę „dobrze”, a zamiast oceny „dobrze” ocenę „rewelacyjnie”.

– Kluczowe funkcje wielu platform oparte są o algorytmy niewidoczne dla konsumentów. Dlatego tak ważne jest, żeby przedsiębiorcy działający w e-commerce stosowali uczciwe zasady i metody korzystania z takich narzędzi. Grupa OLX sugerowała, że niektóre oceny użytkowników są wyższe niż w rzeczywistości. Konsumenci nie mieli wglądu w to, jakie oceny cząstkowe składają się na ocenę ogólną użytkownika, ani też dostępu do wystawionych na ich temat komentarzy. Nie zdawali sobie sprawy, że inni użytkownicy platformy mogli być mniej zadowoleni z kontaktu ze sprzedawcą niż wynikało to z ocen prezentowanych w serwisie. W konsekwencji, system ocen sugerował korzystniejsze doświadczenia zakupowe konsumentów, aniżeli wynikało to z realnych doświadczeń transakcyjnych, co mogło zachęcać kolejnych użytkowników do dokonania zakupu na OLX.pl – mówi Prezes UOKiK Tomasz Chróstny.Nowy system ocen

Praktyki kwestionowane przez Prezesa UOKiK spółka stosowała od listopada 2020 r. do 31 lipca 2024 r. Przez ponad 3,5 roku użytkownicy serwisu OLX byli wprowadzani w błąd, a ich interesy były naruszane. Dopiero po tym czasie spółka zastąpiła stosowane mechanizmy nowym systemem ocen, który eliminuje zarzuty podniesione przez Urząd. Obecnie ocena ogólna sprzedającego jest wyliczana w oparciu o średnią arytmetyczną wszystkich ocen cząstkowych, do których konsumenci mają wgląd. Oceny te bazują na liczbie przyznanych gwiazdek (od 1 do 5) oraz tagach. Co istotne, mogą je wystawić już wyłącznie osoby, które kupiły i odebrały przedmiot z przesyłką OLX.

Kara dla Grupy OLX to ponad 28 mln zł (28 420 869 zł). Decyzja nie jest prawomocna, spółce przysługuje odwołanie do Sądu Ochrony Konkurencji i Konsumentów. Po uprawomocnieniu się decyzji spółka poinformuje o niej na stronie internetowej OLX.pl oraz na swoich profilach w mediach społecznościowych. Prezes UOKiK prowadzi wobec przedsiębiorcy również postępowanie w sprawie nałożenia kary za wprowadzające w błąd informacje, które spółka przekazywała w odpowiedzi na wezwania do złożenia wyjaśnień.

To nie pierwsza decyzja Prezesa Urzędu wobec Grupy OLX. W ubiegłym roku Prezes UOKiK zobowiązał spółkę do zmiany praktyk dotyczących zakupów z pakietem ochronnym, udzielania informacji o możliwości pominięcia „przesyłki OLX” i opłaty serwisowej oraz uwzględniania opłat dodatkowych w wynikach sortowania od najtańszych ofert.

Polish Competition Authority Penalizes OLX for Misleading Rating System

The Polish competition authority, known as UOKiK, has imposed a fine of over 28 million PLN on OLX Group due to misleading practices in its rating system. The authority found that the platform allowed individuals who had not made purchases to leave reviews, which distorted the reliability of the ratings and misled consumers.

 UOKiK's investigation revealed that the criteria for leaving a review were not clearly communicated to users. Many consumers were unaware that even those who had not purchased anything could rate sellers, leading to complaints about unfair negative reviews. This lack of transparency raised concerns about the integrity of the ratings system, which is crucial for online shoppers.

 Additionally, the algorithm used by OLX to calculate overall ratings was found to favor positive reviews disproportionately. Negative ratings were downplayed, and consumers could not verify the accuracy of the ratings they saw. This manipulation of ratings could mislead potential buyers about the quality of sellers on the platform.

 UOKiK noted that these practices had been in place since November 2020 and continued until July 2024, during which time consumers were misled about the reliability of the ratings. Following the investigation, OLX has since implemented a new rating system that requires only verified buyers to leave reviews, thus addressing the concerns raised by the authority.

 The fine imposed on OLX is not yet final, as the company has the right to appeal the decision. UOKiK is also investigating OLX for providing misleading information in response to inquiries about its practices.



Mylący system ocen na OLX.pl – decyzja Prezesa UOKiK

The Bundeskartellamt has today prohibited plans by Tönnies International Management GmbH to acquire several companies and assets from Vion GmbH and Vion Beef B.V., in particular the slaughterhouses in Buchloe, Crailsheim and Waldkraiburg.



Andreas Mundt, President of the Bundeskartellamt: “The takeover of Vion’s facilities raised competition concerns as it would have strengthened Tönnies’s market position to the detriment of the farmers and smaller competitors remaining in the regions affected. In addition to its already dominant position in the pig slaughtering and processing industry in Germany, Tönnies would also have gained a leading position in the slaughter and processing of cattle. The takeover would reduce options for producers and customers to switch to alternative companies, thus expanding the Tönnies Group’s market position and scope of action. It would also have brought disadvantages to buyers of slaughter products throughout Germany.”



The Tönnies Group based in Rheda-Wiedenbrück is a family-owned company focusing on the slaughter and cutting of pigs, sows and cattle, the utilisation of slaughter by-products and the production of meat products from pork, sow, beef and poultry meat. The group employs more than 20,000 staff. In the 2023 business year it achieved global turnovers of approximately 7.8 billion euros.



The seller, Vion Food Group, based in Boxtel (Netherlands) is a global producer of meat, meat products and plant-based (meat) alternatives. The group owns production sites and trading companies in the Netherlands, Germany and other European countries. In 2023 its turnover amounted to approximately 5.1 billion euros.



In June 2024 Vion announced its intention to discontinue most of its previous business activities in Germany and to sell its facilities located in Germany. In the context of this process, the Bundeskartellamt and the European Commission have, since early 2024, already examined several merger projects relating to former Vion sites, all of which have so far been cleared.



The planned takeover affects several areas relating to the slaughtering and sales of meat, which have to be differentiated from a competition perspective. These areas include the procurement of cattle and pigs for slaughter, the slaughtering process, meat cutting and sales of slaughter products. In a complex value chain, meat and slaughter by-products are processed into meat products, among other products, and are subsequently sold.



With regard to procurement and slaughtering, the competitively relevant markets are defined as regional markets according to the different catchment areas of the slaughterhouses. The market definition was based on radii between 200 and 300 kilometres of driving distance. In contrast, the markets for processing and selling meat products are at least national in scope.



The Bundeskartellamt conducted extensive surveys among competitors and customers and analysed the structures of the procurement of animals for slaughter based on the slaughterhouses’ procurement data as well as on databases of the German Federal Government and the Länder. On this basis, the authority has reached the conclusion that the merger would result in the creation or strengthening of a dominant position for Tönnies in several regional slaughter markets in southern and eastern Germany.



Vion has so far been the market leader with regard to the slaughter of cattle in southern Germany. The Waldkraiburg and Buchloe facilities exclusively focus on cattle slaughtering and cutting services. At the Crailsheim slaughterhouse both cattle and pigs are slaughtered and cut. Tönnies already operates slaughterhouses in neighbouring areas: Altenburg and Kempten (cattle) and Weißenfels (pigs).



After a takeover of the Vion sites, Tönnies would achieve market shares of well over 40 per cent in the catchment areas of the Buchloe, Waldkraiburg and Kempten slaughterhouses, by far exceeding the market shares of the remaining, significantly smaller competitors.



In addition, in the regional market for the slaughtering of pigs which is defined by the catchment area of the Weißenfels slaughterhouse, the proposed merger would result in strengthening the dominant position already held by Tönnies in this area. Tönnies already enjoys a significant market share lead with regard to the slaughtering of pigs in this area and would be able to expand this position even further by acquiring the Crailsheim site, whose catchment area overlaps with the market area surrounding the Weißenfels site.



The merger would also enable Tönnies to expand its role as the German market leader in the markets for the sale of pigs (whole or half) and pig meat, and to become the market leader in the market for the sale of cattle (whole or half).



Other factors indicating that Tönnies would achieve dominant positions were market entry barriers for potential new competitors, economies of scale in accessing procurement and sales markets, interconnections and links between Tönnies and other companies, the Tönnies Group’s vertical integration and financial strength and limited options for farmers as producers to switch to alternative buyers. These factors have an impact on a market in which the supply of animals for slaughter is declining more significantly than the demand for meat.



The parties were informed of the Bundeskartellamt’s competition law concerns in a statement of objections sent to them in March 2025. In late April the parties submitted commitment proposals with the aim to dispel the competition concerns. The proposals referred to the divestment and leasing of facilities to acquirers designated by Tönnies. However, in the Bundeskartellamt’s view, these commitments were not capable of preventing the creation or strengthening of the group’s dominant positions in the markets affected by the merger, considering the specific details of the commitments and the fact that the proposed acquirers would not be independent from the Tönnies Group.



The Bundeskartellamt’s decision is not yet final. It can be appealed to the Düsseldorf Higher Regional Court.

German Authority Blocks Tönnies' Acquisition of Vion Slaughterhouses

 Additionally, the merger would bolster Tönnies's already strong position in the regional market for pig slaughtering, further consolidating its market leadership. The Bundeskartellamt identified several factors contributing to Tönnies's potential dominance, including high market entry barriers, economies of scale, and limited options for farmers to switch buyers.

 In response to the authority's concerns, Tönnies submitted commitment proposals aimed at addressing the competition issues, including divesting and leasing facilities to designated acquirers. However, the Bundeskartellamt deemed these commitments insufficient to prevent the creation or strengthening of Tönnies's dominant positions. The decision is not final and can be appealed to the Düsseldorf Higher Regional Court.
